TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND THIS POLICY ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR DATA PRACTICES WILL MEET YOUR REQUIREMENTS OR THAT PROCESSING WILL BE ERROR-FREE OR UNINTERRUPTED.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALEPH AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO THIS POLICY OR OUR PROCESSING OF PERSONAL DATA, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THIS POLICY OR OUR PROCESSING OF PERSONAL DATA SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE RELEVANT SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100).

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

16. Indemnification

You agree to defend, indemnify, and hold harmless Aleph and its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, demands, actions, losses, liabilities, damages, fines, penalties, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Services; (b) personal data you submit, or cause to be submitted, to us; (c) your violation of this Policy, the Terms, or applicable law; (d) your infringement of third-party rights; or (e) any dispute between you and a third party relating to your use of the Services or data you provide.

We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense at your expense.

We may update this Policy at any time. Material changes will be reflected by updating the "Last updated" date and, where required by law, by providing additional notice. Your continued use of the Services after changes become effective constitutes acceptance of the revised Policy.

18. Governing Law

This Policy is governed by the laws of the United Arab Emirates, without regard to conflict-of-law principles, except where mandatory local data protection rules apply to you as a data subject.
